ANNOUNCEMENT
PUBLIC TENDER FOR THE ALLOCATION OF THREE RIGHTS OF USE OF NATIONAL FREQUENCIES FOR THE FOURTH GENERATION OF PUBLIC TERRESTRIAL MOBILE COMMUNICATIONS SYSTEMS (4G)
1. Subject: The purpose of this invitation to tender is to grant three rights of use of frequencies at national level for fourth generation public terrestrial mobile communications systems (4G) in the 800 MHz and 1800 MHz bands. It is incumbent upon the Multi-Sectoral Regulatory Agency of the Economy (ARME) to determine, after the decision on the technological systems to be used, the necessary bandwidths and guard bands within the spectrum indicated for use.
2. Applicants: Commercial companies incorporated or to be constituted in Cape Verde, which fulfill the requirements set forth in article 19 of Legislative Decree no. 7/2005, may apply for the allocation of the rights of use of frequencies under this invitation to tender, of 28 November, as amended by Legislative Decree No.2 / 2014 of 13 October.
The companies to be incorporated in Cape Verde may apply, however the right to use frequencies will be issued, upon presentation, within 60 (sixty) calendar days from the date of communication by ARME of the result of the competition, of the proof of the effective registration of the company agreement in the competent trade register.
3. Obtaining tender documents: The tender documents can be obtained at ARME's Headquarter, Avenida da China - Chã d'Areia, 5th Floor, every working day from 9 am to 4 pm from the day of publication of the announcement until the last day set for the submission of tenders, against the payment of a fixed and non-refundable sum of $ 250,000 (two hundred and fifty thousand escudos), equivalent to € 2,267.27 (two thousand, two hundred and sixty-seven euros, and twenty-seven cents).

4. Place and deadline for submission of tenders: Tenders must be delivered by 4:00 pm on February 22, 2019 at the of ARME front office , against a receipt proving delivery, on working days between 9:00 am and 4:00 pm, or sent by registered mail to ARME, Avenida da China - Chã d'Areia, 5th floor, CP No. 892 - Praia, Cape Verde, provided that the reception takes place within the established period, not being considered the proposals arrived after the deadline, being the applicants responsible for any delays that may occur.
5. Language of the documents: All the documents which instruct the tender, as well as the correspondence exchanged under this invitation to tender must be written in Portuguese, French or English, or, if not, must be accompanied by a legal translation and in respect of which the competitor declares to accept the prevalence, for all purposes, over the respective originals.
6. Public opening of the applications: The public opening the packages with the identification of the applicants, the technical plan and the economic and financial plan, will take place at 10 o'clock on February 25, 2019, at the headquarters of ARME.
7. Regulation of the Tender: The criteria and provisions governing the allocation of frequencies, as well as the instruments that instruct the application and the other rules applicable to this competition are published in a specific regulation approved by Resolution No. 93/2018 of 14 September, published in the First Series of Official Gazette no. 59 of September 14, 2018.
